Unpaid Wages

North Carolina’s Wage and Hour Act and the federal Fair Labor Standards Act govern the payment of minimum wage, overtime wages, and unpaid wages.

Many people mistakenly believe that they are not entitled to overtime pay because they are paid a “salary.” This is often not the case.

Whether an employee is exempt from being paid overtime is determined by the duties the employee performs. The employer has the burden of proving that an employee is properly classified as exempt.

We invite people to educate themselves about the Wage and Hour Act and the Fair Labor Standards Act. However, due to the complexity of this area, we urge everyone with a question to consult with an attorney before pre-judging whether or not their employer has acted unlawfully.
