We have set important precedents for North Carolina public employees. In Simpson and Faulkenbury, we protected the rights of vested firefighters, law enforcement officers, teachers and other public employees. The legislature had changed the formula for calculating their disability retirement benefits. The North Carolina appellate courts held that changing the formula after these employees worked five years and vested was unconstitutional. In other words, the firm established the principle that once a public employee vests, the government cannot retroactively lower the employee’s promised benefits.
