Separation Agreements

If you and your spouse are considering a separation agreement, Kathryn Schiller can assist you and provide you with legal advice during the drafting and negotiation process.

A separation agreement can be the most efficient and effective way to resolve divorce issues. A separation agreement has the advantage of resolving divorce issues in a private manner outside of court in a document that is binding and enforceable, and is considerably more time-efficient and cost-effective than litigation. Entering into a separation agreement also provides both you and your spouse with more certainty and control over the final terms of the resolution of your marriage.

A separation agreement generally resolves all issues relating to child custody, child support, division of property, and alimony. However, a separation agreement can resolve any issue the couple is willing to agree upon.

It is important to bear in mind that a separation agreement is a contract. It is not a court order. However, a separation agreement can be enforced in court by filing a breach of contract case if one spouse violates the terms of the separation agreement.
